General information
The contract of carriage is concluded only under the conditions of these GTC. Conflicting conditions will not be accepted. These GTC, the tariff regulations, the officially approved conditions of carriage and the rules of conduct of the International Ski Federation (https://www.alpinesicherheit.at/de/FIS-Regeln/) are part of the contract of carriage. The General Terms and Conditions, the Tariff Conditions, the Rules of Conduct of the International Ski Federation (FIS), the General Terms and Conditions of the Voucher Shops are accessible to everyone on the Internet at www.berwang.tirol and are also available for inspection at the main ticket offices on request. The conditions of carriage are posted at the entrances to the lifts and are also available for inspection at the ticket offices.
The individual services to which the tickets entitle are provided by legally independent companies. The company selling the ticket acts for other companies only as their representative. Only the respective company is therefore obliged to provide the individual services and to pay compensation in the event of any incidents.
In case of violation of the conditions of carriage, of the ban on ski runs (e.g. due to avalanche danger, the ban on skiing in forest areas or the FIS rules, the skier will be excluded from carriage. In serious cases and in case of repeated violation, the ski pass will be withdrawn without compensation and a criminal complaint will be filed with the authorities. In all other cases, the orders of the employees of the cable car company must be followed.
Validity
As a rule, the validity begins on the day of issue. On request, all ski tickets except relay and 2.5-day tickets can be purchased in advance. Ski tickets are always valid on consecutive days. An interruption is not possible (except for optional subscriptions).
The use of the lifts (cable cars and lifts) requires the possession of a valid ski pass. The cable car company does not owe the owner of a valid ski pass any transport if use is impossible or inadmissible for reasons for which the cable car company is not responsible: such reasons include weather conditions (e.g. strong wind), avalanche danger, standstill due to prescribed maintenance work or technical faults.
The valid ski pass entitles the holder to use all the facilities in operation within the period of validity according to the tariff and transport conditions and these General Terms and Conditions. The ski pass is not transferable. Subsequent exchange, postponement or extension of the validity is not possible. Days not used lose their validity and are neither refunded, replaced nor credited.
The validity of the ski passes is checked at the valley and mountain stations of the ski lifts by readers and/or by the employees of the cable car company. The instructions of the employees of the cable car company are to be followed and the readers are to be used as intended. The validity of ski passes can also be checked at each lift station, in the cash desk area or in the car parks. Here, too, the ski pass must be presented to the employees of the cable car company at any time upon their request and the instructions must be followed.
Prices and discounts
The current prices for the various services can be found in the price list provided. Prices are subject to change.
All stated prices are in Euro and include the statutory VAT. Payment must always be made in advance. Payment options at the ski pass cash desks: Cash in Euro, Bankomat (Maestro) or credit card (Mastercard, Visa).
Reductions (children, youth, senior citizens, mini, families, disabled persons) are granted without exception only on presentation of photo identification. Please understand that our cashiers are not allowed to make exceptions.
A disability reduction is granted from a documented degree of disability of 60%.
If reductions offered are taken up, the rightful entitlement must be proven by corresponding official documents.
Unlawfully claimed reductions result in the withdrawal of the ski pass. We reserve the right to file a criminal complaint.
The company reserves the right to limit the issue of all or individual tickets in case of low snow conditions or imminent crowding of ski slopes. The company also reserves the right to change prices, even on a daily basis.
A group discount is only granted when tickets of the same validity period are purchased together by a group leader.
Discounts during the Superski Weeks are only granted on presentation of the guest card at the time of purchase. Please ask your landlord for the guest card upon arrival.
With the purchase of a named ski pass, the cardholder agrees to the automatic registration of his personal data. Furthermore, the cardholder agrees that these data will be recorded, processed and deleted for control purposes to prevent misuse of the card and as soon as they are no longer required, at the latest after the expiry of the legal storage period.
Refund
There is no legal claim to reimbursement. Any refunds are purely as a gesture of goodwill. In case of ski accidents, the purchase price can be refunded proportionally with a validity period of at least two days for a processing fee of € 10.00. The prerequisite for this is in any case the immediate deposit of the ski pass of the injured person at one of our insurance companies, as well as the presentation of a medical certificate from a local doctor or hospital. A refund can only be made if the ski pass has not been used after the accident and will be paid from the day of deposit at one of the insurance companies, but at the earliest from the day after the ski accident. Any rescue and care costs incurred by the piste rescue service are not included in the ski pass price and will be invoiced separately. A refund for ski passes of persons accompanying the accident victim is not possible.
Premature departure, bad weather, interruptions in operation or shutdown of facilities or piste closures due to events beyond the control of the company (weather, wind, natural hazards, etc.) do not give entitlement to a refund or extension of the validity period.
The company also reserves the right to shut down some installations during or at the end of the season (e.g. due to snow conditions). Here too, no reimbursement/price reduction will take place.
Misuse
Ski tickets are personal and not transferable. Any attempted or actual misuse of the ski pass and the circumvention of the reading devices will result in the immediate withdrawal of the ski pass and the levying of an increased transport charge, without prejudice to any criminal consequences. We reserve the right to file criminal charges.
Replacement for lost and damaged ski passes
There is no legal claim to the replacement of lost or defective ski passes.
For lost or damaged ski passes with a validity of at least three days, a new ski pass can be issued for a processing fee of € 10.00 (plus € 2.00 deposit). If the ski pass has already been used on the day of the loss report, the validity of the newly issued ski pass is limited to the days following this day.
Defective ski passes (without any visible external damage) can only be renewed on presentation of the proof of purchase.
If ski passes (such as season tickets) are forgotten, a corresponding day ticket must be purchased. A refund is generally not possible.
Closing time and piste closure
Please note the closing times of the lifts and cable cars. Weather-related closures of lifts and lifts and limited ski operation will be charged especially during the winter season.
The use of the entire ski area after closing time of the slopes is life threatening and therefore strictly forbidden. During this time, avalanche blasting and piste preparation (sometimes with cable winches not visible to the skier) take place regularly and there are no more control runs by the piste service.
KeyCard
Ski passes are usually issued on electronic data carriers (KeyCards), for which a deposit of €2.00 is charged. A return of undamaged, functional reusable KeyCards from the current winter season is guaranteed at our ticket offices. We ask for your understanding that, due to technical developments, no return can be guaranteed for older KeyCard generations.
For one-way KeyCards, which are issued for ski passes with a validity period of up to 2.5 days, no deposit will be charged and will therefore not be refunded.
Return options for undamaged KeyCards and refund of the deposit at the ticket offices, as well as on a voluntary basis at rental companies, sports shops and restaurants.
Guest card
Ask for the guest card from your landlord upon arrival.
Liability
Claims for damages can only be asserted in the event of deliberate or grossly negligent conduct by the railway operator. This restriction does not apply to compensation for damage to persons or to claims for compensation under the German Railway and Motor Vehicle Liability Act (EKHG) or the Product Liability Act.
In principle, only the respective service provider is liable for damages arising in connection with the use of third-party services. Berwang Cableways are not liable for damages caused by other piste users or other third parties. In the case of particularly reckless and dangerous skiing, as well as in the case of disregard of closures or other orders, the exclusion of transport must be expected. We strive for your safety and ask you to observe the FIS rules.
No liability is accepted for personal items belonging to visitors (including skis, snowboards etc.).
Choice of law and place of jurisdiction
This contractual relationship is exclusively subject to Austrian law. For disputes arising from this contractual relationship, the Austrian court that is responsible for the headquarters of Bergbahnen Berwang is exclusively responsible.
Final provisions
These terms and conditions may be amended or revised at any time and shall apply from the day following their re-publication on the website.
The invalidity of one or more provisions of these GTC or of the contractual relationship governed by these GTC shall not affect the validity of the remaining agreement.
